Welcome to LeMed Spa. These Terms of Service ("Terms") govern your use of the services provided by LeMed LLC (dba "LeMed Spa"), including our website at lemedspa.com, our messaging programs, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Services Overview

LeMed Spa provides medical aesthetic treatments, skincare services, and related consultations at our location at 17414 Ventura Blvd, Encino, CA 91316. Our Services include but are not limited to: in-person aesthetic treatments and consultations, appointment scheduling and management, product sales, and communication through various channels including phone, email, and text messaging.

2. Eligibility

You must be at least 18 years old to use the Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Appointments and Cancellations

Appointments may be scheduled through our website, by phone at 818-463-3772, or through our messaging services. We request at least 24 hours' notice for appointment cancellations or rescheduling. Late cancellations or no-shows may be subject to a cancellation fee as disclosed at the time of booking.

4. Messaging Program Terms

LeMed Spa offers text-based messaging services, including SMS, MMS, and RCS messages (collectively, the "Messaging Program") for appointment reminders, service updates, and operational communications.

b. Program Description: When you opt in, you may receive text messages from LeMed Spa regarding appointment confirmations and reminders, service availability and updates, booking and scheduling information, account notifications, and responses to your inquiries.

c. Message Frequency: Message frequency varies based on your interactions with LeMed Spa. You may receive up to 10 messages per month, depending on your appointment schedule and communication preferences.

d. Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan and any applicable charges.

e. Opt-In: By providing your mobile phone number and consenting to receive messages from LeMed Spa, you are opting into the Messaging Program. Consent is not required as a condition of purchasing any goods or services.

f. Opt-Out: You may opt out of the Messaging Program at any time by replying STOP to any message received from LeMed Spa. After opting out, you will receive a one-time confirmation message. You will no longer receive messages from the Messaging Program unless you opt in again.

g. Help: For help or questions about the Messaging Program, reply HELP to any message or contact us at 818-463-3772 or info@lemedspa.com.

h. Supported Carriers: The Messaging Program is available on all major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, and others. However, service availability may vary depending on your carrier and device.

i. Carrier Disclaimer: Carriers are not liable for any delayed or undelivered messages.

5. Payment Terms

Payment for services is due at the time of treatment unless otherwise arranged. We accept major credit cards and other payment methods as posted at our location. Pricing for services and products is subject to change without prior notice. Any applicable taxes will be added to the total amount due.

6. Medical Disclaimer

LeMed Spa provides aesthetic medical treatments performed by licensed professionals. The information provided through our Services is for general informational purposes and should not be considered a substitute for professional medical advice, diagnosis, or treatment. Treatment results may vary from person to person, and no specific outcome is guaranteed.

7. Intellectual Property

All content on our website and Services, including but not limited to text, graphics, logos, images, and software, is the property of LeMed LLC or its content suppliers and is protected by U.S. and international copyright laws. LEMEDSPA is a registered trademark of LeMed LLC. You may not use, reproduce, or distribute any content from our Services without prior written permission.

You agree not to: use the Services for any unlawful purpose, interfere with or disrupt the Services, attempt to gain unauthorized access to any part of the Services, use any automated system to access the Services, or impersonate any person or entity in connection with the Services.

9. Limitation of Liability

To the fullest extent permitted by law, LeMed LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to LeMed Spa in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LeMed LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
